How is fairforce.one financed?

In short: German law on damages and B2B software licences. The business model is based on two pillars.

The first pillar is Section 249 of the Civil Code: In the event of an accident through no fault of your own, the party responsible’s liability insurance is legally obliged to cover the full cost of repairing the damage – which also includes the costs of case management and legal proceedings. fairforce.one claims these costs from the opposing party’s insurer in accordance with the applicable Lawyers’ Fees Act (RVG). In practical terms, this means that the costs are reimbursed for victims of accidents through no fault of their own. The entire service is 100 per cent cost-neutral for them.

Pillar two is the technology business: The parent company, fairforce.systems, has been developing and marketing a legal tech platform since 2017. Stakeholders connected to the network pay software licence and transaction fees for the cloud-based software provided, which enables them to process claims quickly and highly efficiently. The company’s value is created through the IT-driven scaling of a process that would otherwise be highly manual and bureaucratic.

What does accident settlement with fairforce.one cost?

When accident victims instruct us to handle the settlement of their through no fault of their own accident, we will invoice you for the enforcement of your claims in accordance with the German Lawyers' Fees Act (RVG).

These costs, just like all other claims to which the injured party is entitled, are recovered from the insurer liable for payment.

For our customers, this means:

    1. You will not be charged our fee yourself, as our remuneration forms part of the statutory claim for damages. And this is paid by the other party’s insurance company.

    1. As the amount of the RVG fee is regulated by law and is calculated on the basis of the amount of damages awarded, we share a common interest: to ensure that accident victims actually receive the full amount to which they are legally entitled.

What does fairforce.one NOT do?

To clearly define the business model and safeguard market integrity, fairforce.one adheres to the following established principles:

1. No fabrication or artificial exaggeration of claims

The company uses only legitimate Claims and does not endorse any reports drawn up merely as a favour or unjustifiably inflated claims. fairforce.one pursues only valid and legally sound claims, in order to protect the insurance community from unjustified costs.

2. No lack of transparency regarding funding

The fee structure is based transparently on the statutory fees set out in the Lawyers’ Fees Act (RVG), which, in the case of accidents for which the client is not at fault, are to be reimbursed by the opposing party’s insurance company.

The software licence and transaction fees paid by partners affiliated with our legal tech platform are not borne by the injured party or deducted from the compensation awarded.

3. No general or unauthorised legal advice

In order to achieve the highest possible level of specialisation and quality in claims settlement, fairforce.one focuses on the area of compensation for road traffic accidents. fairforce therefore does not provide traditional legal advice outside the scope of accident claims settlement (such as employment, family or contract law). Its activities are strictly confined to the scope of the licence granted by law to registered legal service providers under the Legal Services Act (RDG).

4. No pure automation without a supervisory body

Technology and algorithms are used to improve efficiency and verify data (e.g. fraud detection), but they do not replace the human element. Each case is handled by a dedicated contact person to rule out erroneous, purely automated decisions (the ‘human-in-the-loop’ principle).

5. No physical workshop or survey services

fairforce.one is a purely digital coordination platform. We do not operate our own garages, maintain our own fleet of hire cars or employ our own vehicle assessors; instead, we exclusively coordinate and evaluate certified external service providers.

6. No vehicle sales or purchase of residual value

fairforce.one is neither a car dealership nor a residual value buyer. We do not act as an intermediary for the sale of new or used cars, nor do we purchase vehicles that have been in accidents.

7. No debt collection agency for claims outside the sector

fairforce.one does not provide general debt collection services for unpaid invoices (e.g. for tradespeople or online shops), but exclusively enforces claims for damages arising from road traffic accidents. However, for stakeholders and partners, we offer bespoke consultancy services to help design an efficient and legally compliant process, from invoicing through to enforcement.
